Article 1. General provisions

The e-commerce website of Golazo Sports NV, a limited liability company (NV) with registered office at Schoebroekstraat 8, 3583 Beringen, (hereinafter ‘Golazo Sports NV’) offers its customers the opportunity to purchase products from its online shop online.

These General Terms and Conditions (‘Terms and Conditions’) apply to any order placed by a visitor to this e-commerce website (‘Customer’). By placing an order via Golazo Sports NV's online shop, the Customer agrees to the applicability of these Conditions to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, unless previously, in writing and expressly accepted by Golazo Sports NV.

Article 2. Price

All prices stated are in EURO, always including VAT and all other duties or taxes payable by the customer. If delivery, reservation or administrative costs are charged, this will be stated separately. The stated price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

Article 3. Offer

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind Golazo Sports NV. Golazo Sports NV is only bound by an obligation of means as to the accuracy and completeness of the information provided. Under no circumstances shall Golazo Sports NV be liable in the event of manifest material errors, misprints or printing errors.

If the customer has specific questions about e.g. sizes, colour, availability, delivery time or delivery method, we request the customer to contact our helpdesk in advance (shop@brusselsmarathon.be). The offer is always valid while stocks last and may be modified or withdrawn by Golazo Sports NV at any time. Golazo Sports NV cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.

Article 4. Online purchases

By selecting the articles, the Customer can himself fill his shopping cart with the desired purchases. By selecting the shopping cart, he always gets a complete overview of: items included in the order, individual price of the items concerned, total price including VAT of the entire purchase, shipping costs charged for delivery of the order. Discounts will only be granted if the Customer enters the correct voucher code in the appropriate field when entering their purchase.

Confirmation of the purchase without registration of the voucher code cannot give rise to the refund of a certain discount amount after ordering. The Customer is responsible for registering the correct delivery address to avoid incorrect shipping.

The customer must pay the full purchase amount via online payment after choosing between the available payment options.
Golazo Sports NV is entitled to refuse an order due to a serious fault on the part of the customer in relation to orders involving the customer.

Article 5. Delivery and execution of the agreement

Items ordered via this webshop will be delivered in Belgium and the Netherlands. For deliveries elsewhere, Golazo Sports NV must be contacted in advance.

Unless expressly agreed otherwise, the goods will be delivered to the customer's place of residence within 30 days of receipt of the order.Any visible damage and/or qualitative defect of an item or other failure in delivery must be reported by the customer to Golazo Sports NV without delay.

The risk due to loss or damage passes to the customer as soon as he (or a third party designated by him, who is not the carrier) takes physical possession of the goods. However, the risk already passes to the customer upon delivery to the carrier, if the carrier was instructed by the customer to transport the goods and this choice was not offered by Golazo Sports NV.

Article 6. Retention of title

The delivered goods remain the exclusive property of Golazo Sports NV until complete payment by the customer.

The customer agrees to notify third parties of Golazo Sports NV's retention of title if necessary, e.g. anyone who may come to seize items not yet paid for in full.

Article 7. Right of withdrawal

The provisions of this article apply only to Customers who purchase items online from Golazo Sports NV in their capacity as consumers. However, the right of withdrawal may be excluded for certain articles and services. The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving reasons. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the good.

To exercise the right of withdrawal, the Customer must inform Golazo Sports NV, Schoebroekstraat 8, shop@brusselsmarathon.be of its decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post or e-mail). The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.

To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.
The customer must return or hand over the goods to Golazo Sports NV, Schoebroekstraat 8, 3583 Beringen, without delay, and in any event no later than 14 calendar days from the day on which it communicates its decision to withdraw from the contract to Golazo Sports NV. The customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

If the returned goods are somehow diminished in value, Golazo Sports NV reserves the right to hold the customer liable and claim compensation for any diminished value of the goods resulting from the customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items that are in their original packaging, together with all accessories and invoice or proof of purchase can be taken back.

If the customer revokes the contract, Golazo Sports NV will refund all payments received from the customer up to that point, including standard delivery costs, to the customer within a maximum of 14 calendar days of Golazo Sports NV being notified of the customer's decision to revoke the contract. In the case of sales contracts, Golazo Sports NV may wait to make the refund until it has received all the goods back, or until the customer has proved that they have returned the goods, whichever comes first.

Any additional costs resulting from the Customer's choice of a mode of delivery other than the cheapest standard delivery offered by Golazo Sports NV will not be refunded.

Golazo Sports NV will refund the customer using the same means of payment with which the customer made the original transaction, unless the customer has expressly agreed otherwise; in any event, the customer will not be charged for such refunds.

Article 8. Warranty

If the items delivered do not conform to the order placed, the statutory warranty period shall apply. The legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.
If a defect is detected, the Customer must notify Golazo Sports NV as soon as possible. In any event, any defect must be reported by the Customer within a period of 2 months of its discovery. Thereafter, any right to repair or replacement shall lapse.

The (commercial and/or legal) guarantee is never applicable to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, adjustments or changes to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects manifesting themselves after a period of 14 calendar days following the date of purchase, if any, delivery, shall be deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 10. Privacy

The personal data you provide will only be used for the following purposes: our customer management, order processing, sending newsletters, keeping you informed of our activities, advertising and/or marketing purposes.

You have a legal right to access your data, the right to correct or have corrected your data, the right to delete your data, the right to oppose the processing of your data, the right to restrict the processing of your data and the right to transferability of your data. Subject to proof of identity (copy of identity card), you can obtain the written communication of your personal data free of charge by sending a written, dated and signed request to Golazo Sports NV, Schoebroekstraat 8, 3583 Beringen, shop@brusselsmarathon.be.

Article 11. Use of cookies

During a visit to the site, ‘cookies’ may be placed on your computer's hard drive. Article 12. Liability

In all cases where we can be shown to be liable, such liability shall be limited, to the extent permitted by law, to the amount you actually paid for an item. Nothing in these terms and conditions is intended to limit or exclude our liability in cases of wilful intent or gross negligence.

Article 13. Impairment of validity - non-derogation

If any provision of these Terms and Conditions is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.
The failure at any time by Golazo Sports NV to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any right thereof, shall never be deemed a waiver of such provision and shall never affect the validity of these rights.

Article 14. Modification of conditions

These conditions are supplemented by other conditions explicitly referred to and the general terms and conditions of sale of Golazo Sports NV. In the event of contradiction, these Conditions shall prevail.

Article 15. Proof

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16. Complaints procedure - Disputes

If our products do not meet your expectations and you wish to formulate complaints, you can contact us via our customer service. We make every effort to deal with your complaint within 7 working days. You can also submit your complaint via the European Commission's ODR platform (https://webgate.ec.europa.eu). This is a platform set up by the EU for all consumers across Europe.

Our general terms and conditions are exclusively governed by Belgian law, regardless of the Customer's place of residence. In the event of disputes that cannot be resolved out of court, the courts of the jurisdiction of Golazo Sports NV's registered office shall have exclusive jurisdiction
